Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the STR Optimizer Chrome Extension ("the Extension" or "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Extension.

2. License and Use

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Extension for your personal or business use, subject to these terms. You agree not to:

• Reverse engineer, decompile, or disassemble any part of the Extension.
• Attempt to bypass our licensing, API limits, or security mechanisms.
• Use the Extension for any illegal, unauthorized, or malicious purpose.

3. Subscriptions and Payments

Certain features of the Extension require a paid PRO subscription. By selecting a premium tier, you agree to pay the recurring subscription fees indicated at the time of purchase. Payments are processed securely via Stripe. You may cancel your subscription at any time, but we do not offer refunds for partial months or unused time.

4. Disclaimer of Warranties (Use at Your Own Risk)

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. STR Optimizer makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property.

AI Advice & Business Outcomes: The insights, SEO audits, pricing suggestions, and automated inbox replies generated by our AI are for informational and convenience purposes only. You acknowledge that AI can make mistakes, hallucinate, or provide sub-optimal advice. You are solely responsible for reviewing any AI-generated communication before sending it, and you assume all risk for any pricing or business decisions made based on our software. We do not guarantee any increase in bookings, revenue, or search ranking.

5. Limitation of Liability

IN NO EVENT SHALL STR OPTIMIZER, TKN HOSPITALITY LLC, MB DESIGN STUDIO, OR ITS SUPPLIERS BE LIABLE FOR ANY DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF DATA, LOST PROFITS, LOST REVENUE, OR BUSINESS INTERRUPTION) ARISING OUT OF THE USE OR INABILITY TO USE THE STR OPTIMIZER SOFTWARE, EVEN IF WE HAVE BEEN NOTIFIED ORALLY OR IN WRITING OF THE POSSIBILITY OF SUCH DAMAGE.

Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you. In such cases, our total liability to you for any claims arising out of or relating to these Terms or your use of the Service shall not exceed the amount you paid to us for the Service in the twelve (12) months preceding the claim.

6. Third-Party Services and Affiliation

Not Affiliated with any STR platform (including Airbnb, VRBO, Houfy etc.): STR Optimizer is an independent tool. We are not affiliated, associated, authorized, endorsed by, or in any way officially connected with Airbnb, VRBO, Expedia Group, or any of their subsidiaries. All product and company names are trademarks™ or registered® trademarks of their respective holders.

The AI features of this Extension are powered by Google's Gemini API. You agree to comply with Google's respective Terms of Service when generating content.

7. Modifications to the Service and Pricing

Changes to the Extension: We reserve the right to modify, suspend, or discontinue the Extension (or any part thereof) at any time, with or without notice. We may also update these Terms of Service periodically. Continued use of the Extension after any changes constitutes your acceptance of the new terms.

Pricing Changes: We reserve the right to change our pricing, subscription tiers, or feature availability at any time. If you are an active, paying subscriber, any price increases will only take effect at the start of your next billing cycle, and we will provide reasonable advance notice prior to the change.

8. Fair Use, Usage Limits, and Termination

Fair Use Policy: To ensure high-quality service for all hosts, our "Unlimited" tiers are subject to a Fair Use Policy. We reserve the right to impose rate limits, restrict API queries, or temporarily suspend access if we determine, in our sole discretion, that your usage is abusive, automated (e.g., using bots or scripts to query the extension), or significantly exceeds the normal, manual usage patterns of a standard short-term rental host.

Termination for Cause: We reserve the right to immediately suspend or terminate your license key and access to the Service, without prior notice or liability, if you violate any of these Terms, engage in illegal activities, attempt to reverse-engineer the Extension, or use the Service in a manner that harms our infrastructure, third-party APIs, or other users. In the event of termination for cause, you will not be entitled to any refund.

9. Property Limits and Capacity

Subscription Limits: To ensure optimal performance and manage API costs, our standard subscription tiers include specific property tracking limits. The PRO tier allows tracking of up to ten (10) distinct properties, and the Business tier allows tracking of up to thirty (30) distinct properties across supported platforms. Enterprise tier limits and usage are custom and governed by the specific Enterprise Agreement signed at the time of purchase.

Capacity Expansion: Attempting to bypass these property limits via automated scripts or exploits is a violation of these Terms. However, if your portfolio exceeds your current tier's limits, you are highly encouraged to purchase additional license keys or official Property Capacity Add-Ons (when available) to accommodate your growing business needs.

11. Public & Authorized Session Data Warranty

You acknowledge and agree that STR Optimizer operates strictly as a browser-based assistive overlay that parses information already publicly accessible or made visible within your own authorized, authenticated user session on third-party platforms. You represent and warrant that you have all necessary rights, permissions, and authority to access, view, and process any listing, reservation, or communication details within your browser.

12. Host Screening Disclaimer & Complete Indemnification

Not a Consumer Reporting Agency: STR Optimizer is an internal productivity helper and is NOT a "consumer reporting agency" under the Fair Credit Reporting Act (FCRA) or similar domestic or international statutes. Incident tags, blacklist indicators, and associated group flags constitute private host notes and do not constitute consumer reports, investigative files, or official background checks.

Host Discretion & Legal Compliance: You maintain sole and exclusive responsibility for verifying all incident records, guest communications, and booking statuses before making any booking, cancellation, or hosting decision. You agree to comply fully with all applicable federal, state, and local non-discrimination, human rights, fair housing, and public accommodation laws.

Hold Harmless & Indemnification: You agree to defend, indemnify, and hold harmless TKN Hospitality LLC, MB Design Studio, and their officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, regulatory actions, fines, or legal expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of incident tracking or blacklist features; (b) any booking cancellation or refusal of service; (c) any allegation of discrimination or violation of guest privacy; or (d) your breach of any third-party platform terms of service.
